1. DEFINITIONS
In these Terms and Conditions:
- “Glide Miami” refers to Glide Miami LLC, its owners, employees, instructors, agents, and representatives.
- “Guest” or “Participant” refers to any individual who books, pays for, or participates in a Glide Miami experience.
- “Experience” refers to any Seabob rental session, guided tour, private charter, or water activity offered by Glide Miami.
- “Equipment” refers to Seabob devices, safety gear, wetsuits, masks, and any other items provided by Glide Miami for use during an Experience.
2. ELIGIBILITY REQUIREMENTS
2.1 Age Requirements
All participants must be a minimum of 12 years of age to operate a Seabob device. Participants under the age of 18 must have written consent from a parent or legal guardian prior to participation. A parent or legal guardian must be present at the launch location for all participants under the age of 16.
2.2 Physical Requirements
Participants must be comfortable in open water. While strong swimming ability is not required, participants must be able to remain calm and relaxed in the ocean environment. Participants must weigh a minimum of 70 lbs (32 kg) to safely operate the Seabob.
2.3 Health and Medical Conditions
Participants with the following conditions should consult a physician before booking and must disclose these conditions to Glide Miami staff prior to participation:
- Heart conditions or cardiovascular disease
- Epilepsy or seizure disorders
- Pregnancy
- Recent surgery or serious injury
- Any condition affecting balance, coordination, or consciousness
Glide Miami reserves the right to refuse participation to any individual whose health condition, in the reasonable judgment of our staff, poses a risk to themselves or others.
2.4 Substance Use
Participation under the influence of alcohol, drugs, or any substance that may impair judgment or physical ability is strictly prohibited. Glide Miami staff may refuse service to any participant who appears to be impaired, without refund.
3. ASSUMPTION OF RISK AND LIABILITY WAIVER
3.1 Acknowledgment of Risk
By participating in any Glide Miami Experience, the Guest acknowledges and accepts that water-based activities involve inherent risks, including but not limited to:
- Exposure to open water, waves, currents, and marine life
- Physical exertion and fatigue
- Equipment malfunction
- Collision with other watercraft, objects, or persons
- Adverse weather or water conditions
- Personal injury, including cuts, bruises, sprains, fractures, or in extreme cases, serious injury or death
3.2 Voluntary Participation
The Guest confirms that participation is entirely voluntary and that they are physically capable of participating in the chosen Experience.
3.3 Release of Liability
To the fullest extent permitted by Florida law, the Guest agrees to release, waive, discharge, and hold harmless Glide Miami LLC, its owners, officers, employees, instructors, agents, and successors from any and all claims, demands, losses, damages, costs, or expenses arising out of or in connection with participation in any Glide Miami Experience, whether caused by negligence or otherwise.
3.4 Indemnification
The Guest agrees to indemnify and defend Glide Miami against any claims, damages, or expenses (including reasonable attorney’s fees) arising from the Guest’s participation, breach of these Terms, or damage caused by the Guest to third parties or to Glide Miami’s equipment.
4. SAFETY RULES AND CONDUCT
All participants must comply with the following safety rules at all times:
- Follow all instructions given by Glide Miami instructors and staff.
- Wear all provided safety equipment, including the pilot harness, at all times during the Experience.
- Do not operate the Seabob at full power until instructed to do so by staff.
- Maintain a safe distance from other participants, watercraft, and structures.
- Do not attempt to dive deeper than instructed.
- Immediately signal for assistance if you feel unwell, fatigued, or unsafe.
- Do not remove or tamper with any safety equipment.
- Respect marine life and the ocean environment — do not touch coral, fish, or other marine organisms.
Failure to comply with safety rules may result in immediate termination of the Experience without refund.
5. EQUIPMENT USE AND DAMAGE
5.1 Care of Equipment
Guests are responsible for the reasonable care of all Glide Miami equipment during their Experience. Guests must report any damage, malfunction, or concern to staff immediately.
5.2 Liability for Damage
Guests will be held financially responsible for any damage to Glide Miami equipment caused by misuse, recklessness, or failure to follow instructions. The cost of repair or replacement will be charged to the Guest at Glide Miami’s discretion.
5.3 Personal Property
Glide Miami is not responsible for the loss, theft, or damage of any personal belongings brought to or left at the launch location or on the water.
6. CANCELLATION AND REFUND POLICY
6.1 Guest Cancellations
- Cancellations made 48 hours or more before the scheduled Experience: full refund.
- Cancellations made 24 to 48 hours before the scheduled Experience: 50% refund or credit toward a future booking.
- Cancellations made less than 24 hours before the scheduled Experience: no refund.
- No-shows on the day of the Experience: no refund.
6.2 Rescheduling
Guests may reschedule their Experience at no charge if notice is provided at least 48 hours in advance, subject to availability.
6.3 Weather Cancellations
Glide Miami monitors weather and ocean conditions closely. If an Experience is cancelled by Glide Miami due to unsafe weather or water conditions (including but not limited to lightning, high winds, or dangerous surf), the Guest will receive a full refund or the option to reschedule at no charge. Glide Miami’s determination of unsafe conditions is final.
6.4 Cancellations by Glide Miami
Glide Miami reserves the right to cancel any Experience at any time due to safety concerns, equipment issues, or circumstances beyond our control. In such cases, Guests will receive a full refund or the option to reschedule.
7. PHOTOGRAPHY AND VIDEO
7.1 Consent to Photography
By participating in a Glide Miami Experience, the Guest grants Glide Miami permission to photograph and video record the Experience for use in marketing, social media, and promotional materials, unless the Guest explicitly opts out in writing prior to the Experience.
7.2 Guest Photography
Guests may use personal cameras or GoPro devices during the Experience at their own risk. Glide Miami is not responsible for any loss or damage to personal recording equipment.
7.3 Optional Media Package
Glide Miami may offer a professional photo and video package as an optional add-on. Details and pricing will be provided at the time of booking.
8. PRIVACY POLICY
Glide Miami collects personal information (name, email, phone number, and payment details) solely for the purpose of processing bookings and communicating with Guests. We do not sell or share personal information with third parties except as required to process payments or comply with legal obligations. 9. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or a Glide Miami Experience shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida. The Guest consents to the personal jurisdiction of such courts.
10. MODIFICATIONS TO TERMS
Glide Miami reserves the right to modify these Terms and Conditions at any time. Updated Terms will be posted on our website at glidemiami.com with a revised effective date. Continued use of our services following any modification constitutes acceptance of the updated Terms.
11. SEVERABILITY
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
12. ENTIRE AGREEMENT
These Terms and Conditions, together with any booking confirmation and any waiver signed at the time of participation, constitute the entire agreement between the Guest and Glide Miami with respect to the subject matter herein and supersede all prior agreements, representations, or understandings.
PARTICIPANT ACKNOWLEDGMENT
By completing a booking with Glide Miami, the Guest confirms that they have read, understood, and agreed to these Terms and Conditions in their entirety.
